How to Avoid a Cultural Minefield in a Legal Practice

Cross-cultural misunderstandings and other related issues can be a “minefield” for lawyers and can lead to malpractice claims so it’s important to be aware of such cultural differences, says Brampton lawyer-linguist Suzanne Deliscar.

She weighs in on the issue, which was recently the subject of a LAWPRO Magazine article entitled “Manage malpractice risk by recognizing cultural diversity.”

“I think it’s fantastic that LAWPRO has highlighted these issues because a lot of lawyers think malpractice is about failing to address a certain issue or not following instructions as indicated by the client or a drafting error,” she tells AdvocateDaily.com. “Of course those are significant and more common errors that a lawyer may fall into, but cultural issues can be a minefield as well and if you’re not aware of them you could end up at risk.”
